Terms of Service
Last updated
From everyone at Homera, thank you for using our product. We built it to help housemates share a home without the awkward money conversations. Because we do not know every one of our customers personally, we have to put in place some Terms of Service to help keep the ship afloat.
When we say “Company”, “we”, “our”, or “us” in this document, we are referring to Homera, LLC, a Washington limited liability company.
When we say “Services”, we mean our website and app at homera.io and app.homera.io, and any product created and maintained by Homera, LLC, whether delivered within a web browser, a desktop application, a mobile application, or another format.
When we say “you” or “your”, we are referring to the people who own an account with Homera.
We may update these Terms of Service (“Terms”) in the future. Whenever we make a significant change to our policies, we will refresh the date at the top of this page and take any other appropriate steps to notify account holders.
When you use our Services, now or in the future, you are agreeing to the latest Terms. There may be times where we do not exercise or enforce a right or provision of the Terms, however, that does not mean we are waiving that right or provision. These Terms do contain a limitation of our liability.
If you violate any of the Terms, we may terminate your account. That is a broad statement and it means you need to place a lot of trust in us. We do our best to deserve that trust.
Account terms
- You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. We recommend you set up two-factor authentication for added security.
- You may not use the Services for any illegal or unauthorized purpose.
- You are responsible for all content posted to and activity that occurs under your account, including information you enter about your housemates.
- You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
- You must be at least 18 years old, or the age of majority where you live, to hold an account.
Money between housemates
Homera helps you keep track of who owes what. Homera does not move money. We are not a bank, a payment processor, a money transmitter, or a party to any payment between you and your housemates. When you settle up, you pay each other outside Homera, through a service you choose such as Venmo, PayPal, or Zelle, under that service’s own terms. Bill amounts, splits, and “paid” statuses are entered and agreed by you and your housemates. We do not verify them and do not guarantee that anyone will pay. Any dispute about a payment or a split is between you and your housemates. This section is about the money you and your housemates owe each other. Paying for Homera itself is a separate thing, and it is covered right below.
Payment, refunds, and plan changes
- Homera is a paid product. One person pays for the home, and the rest of the home joins at no extra cost. What you pay depends on how many housemates live there. Every plan includes the whole product, and there is no feature you have to pay more to unlock.
- You pick your plan and your billing term (monthly, every 6 months, or yearly) when you sign up, and you pay in advance for that term. The prices and terms in effect are the ones on our sign-up page, and we show you both before you pay. Your card details go straight to our payment processor and do not touch our servers. We do not sell your data.
- Our two free months are earned, not automatic. You earn them one at a time by setting your home up and using it for real: get your housemates in, agree on a bill together, add a task, a grocery, and a note, and pay two bills all the way through. The app shows the full list and where your home is on it. There is no clock on it, and a month your home has earned stays earned, even if your home changes later. The months come off the Homera bill of whoever pays for the home. We can end or change this offer for new homes at any time, and the terms that were live when you signed up are the ones we honor.
- All fees are exclusive of taxes. Where required, we will collect and remit them. Otherwise, you are responsible for any taxes that apply.
- Changing your mind is different. If your home is still going and you simply want to stop, your access runs to the end of the term you paid for and then stops. We do not refund the rest of a term in that case.
- If your home ends before your term does, get in touch at hello@homera.io and we will work it out with you.
- What you pay is set by your home size when you sign up, and we look at it again at renewal. If a housemate moves in or out partway through a term, your price stays the same until your next renewal.
- You need to be paid up to keep using Homera. If a payment does not go through, we will tell you and give you a chance to sort it out before your home loses access.
Cancellation and termination
- You are solely responsible for properly canceling your account. Within the Service, we provide a simple no-questions-asked cancellation link. Because a Homera home is shared, canceling may affect your housemates, and we will make that clear before you confirm. What happens to money you have already paid is in “Payment, refunds, and plan changes” above.
- All of your content will be inaccessible from the Services immediately upon account cancellation. Within 30 days, all content will be permanently deleted from active systems and logs. Within 60 days, all content will be permanently deleted from our backups. We cannot recover this information once it has been permanently deleted. Some records tied to a shared home may remain visible to the rest of that home, as described in the Privacy Policy.
- We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time.
- Verbal, physical, written, or other abuse (including threats of abuse or retribution) of a Company employee or officer will result in immediate account termination.
Modifications to the Service and prices
- We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice.
- If we change the price of a paid Service for existing customers, we will give at least 30 days notice and will notify you via the email address on record. You can cancel before a new price starts, and where the law requires your agreement to a new price, we will ask for it first.
Uptime, security, and privacy
- Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis.
- We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public Internet.
- When you use our Services, you entrust us with your data. You agree that Homera may process your data as described in our Privacy Policy. We access your data only for the limited reasons set out there, such as to help with a support request you make, to fix an error, to keep the Services secure, or where the law requires it.
- We use third party vendors and hosting partners to run the Services. The current list of subprocessors that handle personal data is in the Privacy Policy.
- Under the California Consumer Privacy Act (“CCPA”), our vendors are “service providers”. They process any data you share with us only to provide the Services to you, and not for their own purposes.
Copyright and content ownership
- All content posted on the Services must comply with U.S. copyright law.
- You give us a limited license to use the content posted by you and your housemates in order to provide the Services to you, but we claim no ownership rights over those materials. All materials you submit to the Services remain yours.
- We do not pre-screen content, but we reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Service.
- The Company owns all right, title, and interest in and to the Services, including all intellectual property rights therein, and you obtain no ownership rights in the Services as a result of your use.
Using your information to improve Homera
We use information from your use of Homera, including the content you post and how you use the app, to operate, improve, and develop the Services. This includes training automated systems and machine-learning models that power features such as reminders and suggestions. Wherever we can, we use information that has been aggregated or de-identified. We will tell you before we use your information in a materially new way. You can email us to opt out of the use of information that identifies you to train our models, though some features may work less well if you do. We do not use information about a person who does not have a Homera account to train our models in a way that identifies them. We explain this in plain terms in the Privacy Policy.
Features and bugs
We design our Services with care. However, there is no such thing as a service that pleases everybody. We make no guarantees that our Services will meet your specific requirements or expectations. As with any software, our Services inevitably have some bugs. We track the bugs reported to us and work through priority ones, especially any related to security or privacy. Not all reported bugs will get fixed and we do not guarantee completely error-free Services.
Liability
We mention liability throughout these Terms but to put it all in one section:
You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) any payment, non-payment, or dispute between you and your housemates or any third-party payment service; (iii) unauthorized access to or alteration of your data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to these Terms or the Services, whether as a breach of contract, tort (including negligence), or any other theory of liability.
In other words: choosing to use our Services does mean you are making a bet on us. If the bet does not work out, that is on you, not us. We do our best to be as safe a bet as possible. If you choose to use our Services, thank you for betting on us.
Questions
If you have a question about any of these Terms, please email us at hello@homera.io.
